Abstract
This article examines the legal and geopolitical implications of Russia’s withdrawal from the European Convention on Human Rights (ECHR) and the European Court of Human Rights (ECtHR) jurisdiction. The analysis focuses on the procedural consequences for pending and future applications against Russia, the status of previous judgments, and the broader impact on human rights protection in the region.
The research explores alternative mechanisms for addressing human rights violations in Russia following its withdrawal, considering both international legal frameworks and diplomatic approaches. The article also discusses the precedent this withdrawal sets for the European human rights system and potential reforms to strengthen the Convention’s enforcement mechanisms.
Through comparative analysis with other cases of state withdrawal from international human rights treaties, the article provides insights into the challenges and opportunities for maintaining human rights standards in complex geopolitical contexts.
